These Terms of Service ("Terms") govern your access to and use of the Site and all related services, features, content, and products offered by Moegoods (collectively, the "Service"). By accessing the Site or placing an order, you agree to be bound by these Terms.
Please read these Terms carefully before using the Site. If you do not agree to any part of these Terms, you may not access or use the Site.
These Terms incorporate by reference the following policies, which together with these Terms form the complete agreement between you and Moegoods:

1. Eligibility and Age Requirements

To purchase from the Site, you must be at least the age of majority in your country, state, or province of residence. By placing an order, you represent that you meet this requirement.
1.2 Users Under 18
- Users under 13 years of age are not permitted to use the Site or create an account. We do not knowingly collect personal information from children under 13, in accordance with the U.S. Children's Online Privacy Protection Act (COPPA), the EU General Data Protection Regulation (GDPR), and equivalent laws in other jurisdictions.
- Users aged 13 to 17 (or under the age of majority in their jurisdiction) may only use the Site with the involvement, supervision, and consent of a parent or legal guardian. The parent or guardian is responsible for all orders placed and all payment obligations.

Some anime and manga merchandise may depict mature themes. Such products will be clearly labeled on the product page. You represent that you are of appropriate age to purchase any such items in your jurisdiction.

You may use the Site and the Service only for lawful purposes. You may not:
- Use the Service for any illegal, fraudulent, or unauthorized purpose.
- Violate any laws in your jurisdiction, including copyright, trademark, or consumer protection laws.

- Collectible items and blind box products have inherent variability.
- We reserve the right to limit quantities, discontinue products, or update product information without notice.

Certain products are available exclusively through the Site, may have limited quantities, and are subject to the terms of our Return & Refund Policy.
4.3 Authenticity
Moegoods is committed to selling only authentic, officially licensed merchandise sourced from manufacturers, authorized distributors, and official pop-up events. If you suspect you have received a non-authentic item, please contact us immediately at support@moegoods.store. Verified cases will be resolved under our Return & Refund Policy.
4.4 Pre-Order Items
Pre-order items have specific terms relating to payment, shipping, cancellation, and refunds. Please refer to Return & Refund Policy Section 7 and our Cancellation Policy before placing a pre-order.
5. Pricing, Billing, and Order Accuracy
5.1 Prices
- All prices are displayed in USD unless otherwise specified.
- Prices are subject to change without notice prior to order placement.
- The price shown at the time you complete your purchase is the price you pay.
- Where applicable, import duties and taxes are handled according to our Shipping Policy Section 5.
5.2 Pricing Errors
Occasionally, the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct such errors and, if an order is affected by a significant pricing error, to:
- Cancel the affected order before shipment and issue a full refund, or
- Contact you to confirm whether you wish to proceed at the corrected price.
We will not charge you more than the price displayed at the time you placed the order without your consent.
5.3 Account and Billing Information
You agree to provide current, complete, and accurate purchase and account information for all orders. You agree to promptly update your account information, including your email address and payment details, so that we can complete your transactions and contact you as needed.
5.4 Order Limits and Fraud Prevention
We reserve the right to limit or cancel quantities purchased per person, per household, or per order. Restrictions may apply to orders placed by or under the same customer account, the same payment method, or the same billing/shipping address. We also reserve the right to limit or prohibit orders that, in our reasonable judgment, appear to be placed by resellers or for fraudulent purposes.
6. Intellectual Property
6.1 Moegoods Intellectual Property
The Site, including all content (text, images, graphics, logos, product photography, layouts, and the "Moegoods" name and branding), is the property of Moegoods Limited or its licensors and is protected by international copyright, trademark, and intellectual property laws.
You may not copy, reproduce, republish, upload, post, transmit, distribute, or modify any content from the Site without our prior written permission, except that you may download and print a reasonable number of pages for your personal, non-commercial use.
6.2 Third-Party Intellectual Property
Products sold on the Site feature intellectual property owned by third parties (including anime studios, manga publishers, character designers, and brand holders in Japan, Korea, and elsewhere). All such intellectual property remains the property of its respective owners. Moegoods sells officially licensed merchandise manufactured and distributed under license from these rights holders.
6.3 DMCA / Copyright Infringement Notices
If you believe that any content on the Site infringes your copyright, please send a notice in accordance with the U.S. Digital Millennium Copyright Act (DMCA) to support@moegoods.store with the subject line "DMCA Notice," including:
- A description of the copyrighted work you claim has been infringed.
- The location (URL) on the Site of the allegedly infringing material.
- Your contact information (name, address, phone, email).
- A statement that you have a good-faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
We will investigate and respond to valid notices in accordance with applicable law.
7. User Comments, Feedback, and Submissions
7.1 License to Moegoods
If you submit comments, suggestions, ideas, proposals, product reviews, or other materials to us (collectively, "User Submissions"), whether through the Site, email, social media, or otherwise, you grant Moegoods a non-exclusive, worldwide, royalty-free, perpetual license to use, edit, copy, publish, distribute, translate, and otherwise use such submissions for commercial or non-commercial purposes.

You represent and warrant that your User Submissions:
- Do not violate any third party's intellectual property, privacy, publicity, or other rights.

- Do not contain any viruses, malware, or harmful code.
- Are not submitted using a false identity, misleading attribution, or someone else's contact information.
7.3 Moderation
We may, but are not obligated to, monitor, edit, or remove User Submissions that we determine, at our reasonable discretion, violate these Terms or applicable law. We take no responsibility and assume no liability for User Submissions.

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Moegoods, including but not limited to social media platforms, payment processors, shipping carriers, and licensed merchandise brand sites.

9. Privacy
Your submission of personal information through the Site is governed by our Privacy Policy, which forms part of these Terms by reference.
10. Prohibited Uses
In addition to other restrictions in these Terms, you are prohibited from using the Site or its content:

- To engage in any automated resale activity (including bot-based purchasing of limited-edition pre-orders).

11. Disclaimer of Warranties; Limitation of Liability

To the maximum extent permitted by applicable law, Moegoods Limited, including its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors, shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, lost revenue, lost savings, loss of data, or replacement costs) arising out of or in connection with your use of the Service or any products purchased through the Service, even if advised of their possibility.
In no event shall our total aggregate liability for any claim arising out of or relating to these Terms or the Service exceed the total amount you paid to Moegoods in the twelve (12) months preceding the event giving rise to the claim, or USD 100, whichever is greater.
11.3 Statutory Consumer Rights
Nothing in this Section 11 limits or excludes:
- Liability for death or personal injury caused by our negligence.
- Liability for fraud or fraudulent misrepresentation.
- Any other liability that cannot be limited or excluded under applicable law.
If you are a consumer in the European Union, United Kingdom, Australia, or any jurisdiction that grants non-excludable consumer rights, those rights apply to you in addition to anything in these Terms. See Return & Refund Policy Section 12 for details on regional consumer rights.
12. Indemnification
You agree to indemnify, defend, and hold harmless Moegoods Limited and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers, and employees from any claim, demand, loss, or expense (including reasonable attorneys' fees) made by any third party arising out of:
- Your breach of these Terms.
- Your violation of any law or the rights of a third party.
- Your User Submissions.
- Your misuse of the Site or any product purchased through it.
13. Force Majeure
Moegoods shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, pandemics, or public health emergencies.
- War, terrorism, civil unrest, strikes, or labor disputes.
- Governmental actions, customs or export/import restrictions, or changes in tariffs or regulations.
- Failures of international logistics, shipping carriers, or customs authorities.
- Internet, hosting, or payment processing outages, including those affecting Shopify Inc. or our payment providers.
In the event of a force majeure event causing significant delay, we will notify affected customers and provide options consistent with our Shipping Policy and Return & Refund Policy, including the option of a full refund where appropriate.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles.
14.2 Mandatory Consumer Rights
If you are a consumer residing in the European Union, United Kingdom, Australia, or any other jurisdiction that grants you the right to bring proceedings in your country of residence under non-excludable local consumer protection law, those rights apply notwithstanding Section 14.1. Nothing in these Terms deprives you of the mandatory protections of the consumer laws of your country of residence.
14.3 Informal Resolution First
Before initiating formal proceedings, you agree to contact us at support@moegoods.store to attempt to resolve any dispute informally. Most issues can be resolved quickly through direct communication. We will respond within 30 days of receiving your written notice.
14.4 Jurisdiction
Subject to Section 14.2, any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Hong Kong, except that Moegoods may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property.
14.5 No Class Actions
To the maximum extent permitted by applicable law, you and Moegoods agree that any dispute shall be resolved on an individual basis, and not as a plaintiff or class member in any purported class, collective, or representative action. This provision does not apply where prohibited by applicable consumer law.
15. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.
16. Termination
These Terms remain effective until terminated by you or by Moegoods. You may terminate by ceasing use of the Site. We may terminate or suspend your access at any time, with or without notice, if we reasonably believe you have violated these Terms.
Obligations and liabilities incurred prior to termination shall survive termination.
17. Entire Agreement
These Terms, together with the policies incorporated by reference in the Introduction, constitute the entire agreement between you and Moegoods regarding your use of the Service. They supersede any prior agreements, communications, or proposals.
The failure of Moegoods to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

We may update these Terms from time to time. The most current version is always available on this page, with the "Last Updated" date at the top.
- Material changes that affect your rights will be communicated by email (to customers with accounts or recent orders) and/or through a notice on the Site at least 14 days before the changes take effect.
- Minor or clarifying changes will take effect when posted.
Your continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.
